    Acceptable Use Policy

    1. Purpose

    Dear Tomorrow exists to help people leave meaningful messages for the people they love. The Services are intended for lawful, respectful, personal, and non-abusive use only. They must not be used in any way that harms, threatens, exploits, deceives, harasses, or unlawfully interferes with any person, including any intended recipient of a Message.

    This Acceptable Use Policy (“AUP”) sets out the kinds of use that are not permitted on the platform. It is intended to protect Users, recipients, families, third parties, and the integrity, safety, and security of Dear Tomorrow, particularly because Messages may involve sensitive personal, emotional, family, or end-of-life content.

    By using Dear Tomorrow, you agree to comply with this AUP. You are responsible for all Content you upload, create, store, transmit, schedule, or ask us to deliver, and for ensuring that you have all necessary rights, permissions, and legal authority to do so.

    Violations of this AUP may result in account suspension, termination, deletion of content, and — in serious cases — referral to law enforcement or other competent authorities where required or appropriate by law.

    This Acceptable Use Policy ("AUP") is incorporated into and forms part of our Terms of Service. Capitalized terms used but not defined in this AUP have the meaning given in the Terms of Service. If there is any conflict between this AUP and the Terms of Service on a matter of permitted use, this AUP prevails to the extent of the conflict.

    This AUP applies to your use of the Services and to all Content you upload, create, store, transmit, or ask us to deliver, including Messages scheduled for future or post-death delivery. It applies whichever plan you are on and however you access the Services.

    For the avoidance of doubt, this AUP applies whether Content is private, shared, scheduled, stored, archived, pending delivery, or intended to be delivered only after a future event. It applies whichever plan you are on and however you access the Services. It also applies to any use of the Services by or on behalf of an account holder, including through any device, integration, invitation, recipient-access feature, or other access method made available by Dear Tomorrow.

    2. What You Agree Not to Do

    You agree not to use Dear Tomorrow to create, send, or store messages upload, record, schedule, transmit, deliver, request delivery of, share, or store messages or any other Content, or to otherwise use the Services, that:

    These restrictions apply whether the relevant Content is intended for immediate delivery, delayed delivery, post-death delivery, private storage, recipient access, or any other use within the Services.

    You must not attempt to do any of the prohibited acts below, assist anyone else to do them, or use the Services in a way that is designed to evade this AUP.

    2.1 Harm or threaten people

    • Threaten violence, harm, or harassment against any person recipient, family member, group, organization, or community
    • Bully, intimidate, defame, or harass any person including by sending abusive, humiliating, degrading, coercive, or emotionally manipulative Messages
    • Encourage self-harm, suicide, or eating disorders including by providing instructions, pressure, glorification, or encouragement
    • Reveal the personal information of another person without their consent (doxxing) including addresses, phone numbers, identity documents, financial information, medical information, private photographs, location data, or other sensitive personal data
    • Stalk or surveil another person or use the Services to monitor, control, threaten, shame, or pressure another person
    • Exploit grief, death, illness, family relationships, dependency, or emotional vulnerability in a way that is abusive, coercive, threatening, or harmful
    • Send or schedule Messages intended to cause serious emotional distress, reputational harm, family conflict, blackmail, humiliation, or intimidation

    2.2 Are unlawful or facilitate illegal activity

    • Violate UAE law, the laws of the recipient's jurisdiction, or international law, including applicable cybercrime, privacy, data protection, consumer protection, anti-harassment, defamation, public order, sanctions, and criminal laws
    • Facilitate fraud, money laundering, or tax evasion, including scams, impersonation, deceptive fundraising, false investment opportunities, or requests for unlawful payments
    • Facilitate human trafficking, drug trafficking, or other serious crimes, including weapons trafficking, exploitation, organized crime, bribery, corruption, or evasion of law enforcement
    • Promote terrorism or extremist ideology including recruitment, praise, support, fundraising, propaganda, instructions, or encouragement connected to terrorist or extremist groups or activity
    • Instruct, encourage, or assist any person to destroy evidence, evade legal process, breach court orders, avoid regulatory obligations, or commit any unlawful act
    • Violate sanctions, export control laws, or restrictions applicable to any person, country, entity, or transaction

    2.3 Exploit children

    • Contain sexual content involving minors including child sexual abuse material, child sexual exploitation material, or any sexualized depiction of a person under 18, whether real, fictional, AI-generated, altered, or simulated
    • Groom, sexualize, or harm any person under the age of 18 or attempt to build an inappropriate relationship with a minor
    • Be directed at a minor in any sexual or inappropriate way
    • Solicit, request, obtain, store, share, or threaten to share intimate, sexual, identifying, or exploitative images or information relating to a minor
    • Encourage a minor to hide communications, meet privately, share personal information, bypass parental or guardian supervision, or engage in unsafe, unlawful, or harmful conduct

    2.4 Contain prohibited content

    • Pornographic or sexually explicit material, including non-consensual intimate imagery, sexual deepfakes, revenge pornography, or sexual content involving a person who has not consented to its creation, storage, sharing, or delivery
    • Excessively graphic violence or gore, including content intended to shock, traumatize, threaten, or glorify serious injury or death
    • Hate speech targeting race, religion, gender, sexuality, nationality, or any protected category, including disability, age, ethnicity, caste, color, descent, gender identity, pregnancy, marital status, or any other legally protected characteristic
    • Content that infringes another person's copyright, trademark, or other intellectual property rights, or violates any person's privacy, confidentiality, publicity rights, moral rights, contractual rights, or other legal rights.
    • Content that promotes, encourages, or celebrates violence, abuse, discrimination, dehumanization, or exclusion against any protected group
    • False, misleading, or deceptive content that is likely to cause serious harm, financial loss, reputational damage, panic, or unlawful conduct

    2.5 Compromise our service or security

    • Distribute malware, viruses, ransomware, or any malicious code files, links, attachments, scripts, prompts, or instructions
    • Attempt to gain unauthorized access to our systems, other users' accounts, or recipient links including by guessing, harvesting, sharing, selling, bypassing, or misusing access credentials, OTPs, delivery links, verification links, or authentication methods
    • Reverse engineer, decompile, or attempt to extract source code from the service.
    • Use automated systems (bots, scrapers, crawlers) to access the service collect data, harvest contact details, create accounts, test vulnerabilities, or send, schedule, or retrieve Messages without our prior written permission
    • Bypass rate limits, OTP verification, or other security controls including identity checks, payment controls, storage limits, anti-abuse systems, delivery safeguards, or recipient-access controls
    • Use the service to send spam, phishing emails, or unsolicited commercial messages or to conduct credential theft, social engineering, mass messaging, chain messages, deceptive marketing, or unlawful solicitation.
    • Probe, scan, test, overload, disrupt, interfere with, degrade, or attempt to compromise the integrity, availability, confidentiality, or performance of the Services
    • Use the Services to train, test, or deploy systems that generate abusive, unlawful, deceptive, or security-compromising content

    2.6 Misrepresent or deceive

    • Impersonate another person, including through cloned voices or deepfakes synthetic media, forged signatures, altered images, fake accounts, or misleading identity information
    • Send messages claiming to be from someone you are not or falsely suggest that a Message has been authorized, approved, written, recorded, or scheduled by another person
    • Use false or stolen contact information for recipients including phone numbers, email addresses, identity details, payment details, or emergency contact information
    • Use the service to coerce, manipulate, or extort any person including through threats, conditional gifts, inheritance pressure, relationship pressure, emotional blackmail, reputational threats, or financial demands
    • Misrepresent your authority to upload, store, schedule, or deliver Content on behalf of another person.
    • Create or schedule Messages that are intended to mislead recipients about death, illness, legal rights, inheritance, relationships, identity, consent, financial obligations, or any material fact.

    2.7 High-risk, regulated, or legally operative use

    • Use Dear Tomorrow as a substitute for a will, trust, power of attorney, advance medical directive, guardianship document, court filing, legal notice, professional advice, or other legally operative document
    • Create, store, or deliver Messages that purport to transfer property, give binding legal instructions, change inheritance wishes, create financial obligations, provide medical instructions, or override formal legal documents
    • Use the Services to provide legal, medical, financial, tax, investment, mental health, or other regulated professional advice unless you are properly authorized to do so and the use complies with all applicable laws
    • Use the Services to make emergency communications, crisis communications, or time-sensitive instructions where failure or delay in delivery could cause harm
    • Use the Services for gambling, regulated financial promotions, political campaigning, lobbying, fundraising, or other regulated activity without complying with all applicable laws and obtaining our prior written approval where required

    3. Recipient Consent and Communication

    When you provide a recipient's contact details, or ask us to store, schedule, notify, or deliver any Message to a recipient, you confirm that:

    • You have a reasonable basis to send them a message — for example, an existing personal relationship, family connection, or prior correspondence
    • Where required by applicable law, you have the recipient's consent or another lawful basis to provide their contact details to us and to use the Services for the intended communication
    • The contact information is accurate and current to the best of your knowledge, and you will keep it updated where necessary to avoid misdelivery or disclosure to the wrong person
    • You are not using the platform to contact someone who has asked you not to contact them blocked you, withdrawn consent, objected to receiving communications, or otherwise indicated that they do not wish to hear from you
    • You will not use the platform as a channel to circumvent any restraining order, no-contact order, or similar legal protection in place against you or any court order, family protection order, workplace restriction, school restriction, guardianship restriction, or other legal or personal safety restriction.
    • You will not use the Services to send unwanted, abusive, threatening, harassing, manipulative, misleading, commercial, political, fundraising, or spam communications to any recipient
    • You will not provide contact details for a minor unless you are their parent or legal guardian, or you otherwise have lawful authority to do so, and the Message is appropriate for the minor's age and circumstances
    • You will not provide false, stolen, unauthorized, misleading, or third-party contact information, or use another person's contact details to disguise the true sender, recipient, or purpose of a Message
    • You understand that recipients may be contacted by Dear Tomorrow for the purpose of verification, notification, access, delivery, safety, support, or compliance, depending on the features you use
    • We may refuse, delay, suspend, or cancel delivery of a Message where we reasonably believe the recipient details are inaccurate, the communication is unlawful or harmful, the recipient has objected, or delivery would breach this AUP, our Terms of Service, or applicable law
    • You are responsible for ensuring that any Message you send or schedule is suitable for the intended recipient, including where the Message may be delivered in sensitive circumstances such as illness, bereavement, family conflict, incapacity, or death

    4. Special Cases

    4.1 Messages addressing serious topics

    Dear Tomorrow is built for emotionally significant messages — including those addressing illness, death, and farewells. Such content is welcomed and is not a violation of this AUP. We make a clear distinction between heartfelt messages on difficult topics and content that promotes or glorifies harm. However, the Services must not be used to encourage self-harm, suicide, abuse, violence, unlawful conduct, or serious emotional distress. Dear Tomorrow is not an emergency, crisis, medical, mental health, legal, or counselling service.

    Where we reasonably believe a Message creates a serious safety, legal, or wellbeing risk, we may delay, restrict, refuse, or cancel delivery, and may take any other action permitted under this AUP, our Terms of Service, or applicable law.

    4.2 Messages to minor recipients

    You may schedule messages for delivery to minors — for example, a message to be delivered to your child on their 18th birthday. You should only provide a minor's contact details or schedule a Message to a minor where you are their parent or legal guardian, or you otherwise have a lawful and appropriate basis to do so. Such messages must be appropriate, supportive, and free of any content prohibited under Section 2 of this AUP. Messages to minors must not be sexual, exploitative, grooming, manipulative, coercive, threatening, or designed to encourage secrecy from a parent, guardian, or responsible adult. We may decline to deliver messages addressed to minors that contain prohibited content, including content of a sexual or inappropriate nature. We may delay, restrict, or decline delivery where required by law, where appropriate consent or authority is unclear, or where delivery may be harmful or inappropriate for the minor.

    5. How We Enforce This Policy

    Dear Tomorrow does not routinely review the content of messages. Message content is encrypted and is not accessed by staff for routine operations. We may review or access content in the following circumstances:

    • A user reports another user's account
    • A recipient reports a delivered message as harmful or threatening
    • A lawful authority requests information under a valid court order
    • Automated systems flag suspicious activity, including unusual account behavior (such as rapid mass-recipient additions or suspicious payment patterns) and, where we deploy such tools, automated content scanning to detect potentially harmful or prohibited content (including but not limited to AI-assisted detection of content involving violence, illegal activity, or material harmful to minors). Where automated scanning identifies potential violations, content may be reviewed by authorized personnel as part of our enforcement process described in this policy

    When we determine that a violation has occurred, we may take any of the following actions, depending on severity:

    • Issue a warning to the account holder
    • Remove the offending content
    • Suspend the account temporarily
    • Terminate the account permanently
    • Delete all account data
    • Refer the matter to law enforcement or relevant authorities — including, in cases involving threats of violence or content involving minors, mandatory reporting under UAE law
    • Delay, restrict, block, or cancel delivery of any Message that we reasonably believe may breach this AUP, our Terms of Service, or applicable law
    • Preserve relevant Content, account information, logs, and related records where necessary for safety, enforcement, legal compliance, dispute resolution, or cooperation with competent authorities

    No obligation to monitor. We are not obliged to monitor Content proactively, and the fact that we may review or access Content in the circumstances described above does not create any duty to do so. A decision not to act in a particular case does not waive our right to act in any other case and does not limit any other right or remedy available to us.

    Automated detection. We may use automated tools to help detect activity that may breach this AUP or the law — for example, signals used to detect fraud, spam, or abuse, and automated scanning that flags potentially prohibited material. Automated tools help us prioritize review; they do not replace it. Decisions to suspend or terminate an Account, or to remove Content, involve human review, and how automated processing is used is described further in our Privacy Policy.

    Cooperation with authorities. Where we are required to do so by law, or where we reasonably consider it necessary to prevent serious harm, we may preserve, disclose, or report Content and related information to law enforcement or other competent authorities, including in response to a valid legal request. We may do so without notice to you where the law prohibits us from notifying you or where notice could prejudice an investigation or risk harm.

    Appeals and reinstatement. If we suspend or terminate your Account, or remove Content, and you believe we have made a mistake, you may appeal by emailing [email protected] within 30 days of the action, explaining why you believe the decision was wrong and providing any relevant context. We will:

    • acknowledge your appeal and review the decision, considering any additional information you provide.
    • aim to tell you the outcome of our review within 14 days, or let you know if we need longer; and
    • reinstate your Account or Content where we determine, acting reasonably, that our action was taken in error.

    Reinstatement is not available where your Account was actioned for Content involving the sexual exploitation of minors, credible threats of violence, or other serious unlawful conduct, or where reinstatement would place us in breach of a legal obligation or a direction from a competent authority. An appeal under this Section does not limit any right you have under applicable law.

    6. Reporting Violations

    If you have received a message, you believe violates this AUP, or if you believe an account is being used in violation of this policy, please report it to:

    Reports are reviewed regularly. Where a credible threat to life or safety is reported, we will act immediately.

    7. Changes to This Policy

    We may update this AUP from time to time. Material changes will be notified by email at least 30 days before taking effect. If we make material changes, we will notify you by email or through the Services at least 30 days before the changes take effect, unless a shorter period is required for legal, security, safety, or operational reasons.

    Non-material changes, clarifications, or updates made to address legal, safety, security, or abuse-prevention concerns may take effect immediately. Your continued use of the Services after the updated AUP takes effect means you agree to the updated Policy.
