Nominee and Post-Death Access Policy

1. About This Policy

This policy describes how Dear Tomorrow handles access to your messages after your death. It applies only if you have an active eligible subscription — your account and stored messages remain within the applicable retention period, and you have configured the Nominee feature before your death. The Nominee feature is unique to Dear Tomorrow and addresses a sensitive scenario: ensuring your loved ones can access the messages you have left behind, while protecting against fraudulent claims and misuse. A Nominee is not an executor, heir, legal representative, or substitute for a will, and this policy does not determine inheritance rights, estate ownership, or succession matters. Nominee access is limited to the verification process and access rights described in this policy and remains subject to applicable law, court orders, data protection obligations, and Dear Tomorrow's Terms of Service, Privacy Policy, and Data Retention Policy.

2. Who Can Configure a Nominee

• You must hold an active eligible subscription to configure a Nominee.
• You must be at least 18 years old.
• The Nominee feature is optional. You may choose not to configure one.
• You may change or remove your Nominee at any time. Dear Tomorrow will recognize the most recent Nominee recorded in your Account. The Nominee will not be contacted while you are alive. Where you provide a Nominee's personal details, you confirm that you have a lawful and reasonable basis to provide those details to Dear Tomorrow for the limited purposes described in this Policy.

3. Who You Can Nominate

You may nominate any individual who is:

• At least 18 years old at the time of nomination
• Capable of receiving and acting on a notification (e.g., has a valid email address) and, where required, a valid phone number for verification or secure access purposes
• Not subject to any legal incapacity that would prevent them from receiving the notification or acting as your Nominee
• Able to provide government-issued identification and any supporting verification documents required under this policy at the time Nominee access is requested
• Not prohibited by applicable law, court order, contractual restriction, or other lawful authority from receiving or accessing your messages

Common nominees include spouses, adult children, parents, siblings, close friends, or legal representatives. The Nominee does not need to be related to you. You should nominate someone you trust to handle highly personal messages, recipient details, and account information responsibly. Dear Tomorrow may refuse, suspend, or delay Nominee access if the Nominee cannot be verified, if fraudulent or inconsistent documents are submitted, if there are competing claims, or if Dear Tomorrow is required to do so by law, court order, regulatory request, or safety/privacy concerns.

4. What Information You Provide

When you appoint a Nominee, you may provide:

• the Nominee's full name, preferably as it appears on their government-issued identification;
• their email address, which is required, and phone number, where available;
• their relationship to you, where you choose to provide it;
• their government ID copy and ID type and last four digits, where available. Providing ID information at the time of appointment is optional,
• any optional instructions concerning post-death access or communications with the Nominee.

Dear Tomorrow may later request appropriate identification directly from the Nominee where reasonably necessary to verify their identity and designation during the post-death access process.

You are responsible for taking reasonable steps to ensure that the Nominee information you provide is accurate and current. By providing a Nominee's details, you confirm that you have a reasonable and lawful basis to provide them to Dear Tomorrow for the limited purposes described in this Policy.

We use this information solely to verify the identity of the person claiming Nominee access after your death, administer the Nominee feature, prevent fraud or misuse, protect the privacy and security of your account, and comply with applicable legal or regulatory obligations. We do not contact your Nominee or share any information about you with them while you are alive — except where you specifically ask us to do so or where contact is necessary to implement a notification option you have selected, respond to a lawful request, prevent fraud, or protect the security of the service.

Where we contact a Nominee before post-death verification, we will only share the minimum information reasonably necessary and will not disclose your message content.

5. How Verification Works

After your passing, your Nominee must contact Dear Tomorrow to claim access. The process is:

• Step 1: Nominee emails [email protected] with your account email and a request for Nominee access from the email address registered for the Nominee, where possible.
• Step 2: Nominee submits a certified copy of the death certificate, plus a government-issued photo ID matching the Nominee details you registered. We may also request evidence of any name change, proof of contact details, relationship information, or a signed declaration confirming the accuracy of the information provided.
• Step 3: Dear Tomorrow verifies the death certificate against publicly available records where possible and matches the Nominee's ID against the details you registered.
• Step 4: Verification typically takes 3 to 5 business days, after we receive all required documents, but may take longer where documents are incomplete, issued outside the UAE, difficult to verify, inconsistent, disputed, or require legalization, apostille, translation, or additional review.
• Step 5: If verification succeeds, the Nominee receives a time-limited access link. The link will remain valid until the earlier of: (a) 12 months from the date it is issued; or (b) the end of the applicable data-retention period set out in our Data Retention and Deletion Policy. Accordingly, access may be available for less than 12 months. Access is personal to the verified Nominee, non-transferable, and may be suspended, revoked, or restricted if Dear Tomorrow reasonably suspects fraud, misuse, security risk, competing claims, or a legal/privacy concern.

Before granting access, we may require reasonable evidence to verify the death, the Nominee's identity, and the Nominee's designation under your account. This may include an official death certificate, government-issued photograph identification, evidence matching the name and contact details in your nomination, and, where appropriate, a signed declaration confirming the accuracy of the information provided. We may decline to act on documents we cannot reasonably authenticate and may seek independent confirmation where a claim appears irregular, incomplete, disputed, or high-risk.

Where a death certificate or any other document is issued outside the United Arab Emirates, we may require it to be legalized or apostilled in accordance with the applicable procedure, and to be accompanied by a certified translation into English or Arabic, before we can accept it. This may extend the timeframes described above.

6. What the Nominee Can and Cannot Do

7. If Verification Fails

If the death certificate cannot be verified or the Nominee's identity does not match the details you registered or if the documents provided are incomplete, inconsistent, expired, suspected to be fraudulent, disputed, or subject to competing claims, we will:

• Request additional documentation — for example, a notarized statement, an affidavit, or evidence of legal representation
• The Nominee must contact Dear Tomorrow and submit all requested, complete and verifiable documentation at least thirty (30) days before the applicable grace or data-retention period expires. Submission of documents does not pause or extend that period. If the documents are submitted late, are incomplete, or cannot be verified before the period expires, Dear Tomorrow may close the request and delete the data in accordance with its retention policy, unless applicable law requires otherwise.
• If verification still fails, deny the access request and continue to hold your data in cold storage according to your plan's retention period, without extending, renewing, or pausing the applicable deletion timeline unless required by law, court order, or lawful authority
• Suspend or delay the access request while we review suspected fraud, competing claims, privacy concerns, security risks, or legal objections
• Require a valid court order, probate document, succession certificate, or other lawful authority before granting access where there is a dispute between family members, heirs, representatives, or other claimants

Submitting false or fraudulent documentation is a serious offence under UAE law and will be reported to the relevant authorities. Dear Tomorrow may also permanently deny Nominee access, suspend related account activity, preserve relevant records for legal or fraud-prevention purposes, and cooperate with law enforcement, regulators, courts, payment providers, or other competent authorities where required or reasonably necessary.

8. What If There Is No Nominee — Or the Nominee Does Not Come Forward

If you have not configured a Nominee, or your Nominee does not come forward within the cold storage period, your data is permanently deleted at the end of the period under our standard Data Retention Policy and Deletion Policy and the plan-specific retention period applicable to your account. Dear Tomorrow is not responsible for identifying, locating, notifying, or verifying family members, heirs, executors, legal representatives, or other potential claimants where no valid Nominee has been configured.

Family members, heirs or legal representatives who were not appointed as the Nominee do not have an automatic right to access the User's Account, Vault or Message content solely because of their relationship to the User. Any request for access must be supported by a valid order of a competent court or other legally binding evidence of authority. Dear Tomorrow may assess each request individually, request additional evidence, suspend its decision where competing claims exist, and require the requesting person to obtain an appropriate court order. Dear Tomorrow will comply with any final and binding legal direction applicable to it.

9. Liability and Limitation

Dear Tomorrow performs verification in good faith using the information available to us. We are not liable for:

• Failure to deliver Nominee access if your Nominee does not come forward within the cold storage period
• Decisions made in good faith to deny access where verification fails
• Errors in the death certificate or government records that are outside our control
• Disputes between Nominees and other family members regarding access to your data

No legal, tax, or estate-planning advice. Dear Tomorrow does not provide legal, tax, or estate-planning advice, and nothing in this policy or the Nominee feature is a substitute for a will or for advice from a qualified professional. Laws governing inheritance, digital assets, and post-death access differ between countries and can change, and their application depends on your personal circumstances. You are responsible for ensuring that your arrangements are valid and effective under the law that applies to you, and we encourage you to review them periodically.

10. Privacy and Confidentiality

All Nominee details you provide are encrypted at rest using AES-256, the same as your other personal data. Only authorized verification personnel can access these details, and only when processing a valid Nominee access request after death verification.

We do not share Nominee details with any third party. We do not use the Nominee's information for any purpose other than the verification process described in this policy.

Your Vault may contain Personal Data relating to Recipients and other individuals. A Nominee may access that information only for the purpose of exercising the post-death access rights granted under this Policy and must handle it lawfully, securely and confidentially.

Once the information has been provided to the Nominee, the Nominee is responsible for any subsequent use, disclosure or publication of it and may be treated as an independent controller under applicable data-protection law.

As a condition of access, the Nominee must accept and comply with the responsibilities stated in this Policy. No separate notice will be provided unless required by applicable law.

Nominee availability and cold-storage periods depend on your plan, as shown on our pricing/plans page and in the Data Retention Policy.

11. Changes to Your Nominee

You can update or remove your Nominee at any time during your active subscription:

• Account settings → Nominee → Edit / Remove
• Or email [email protected] with your registered email address.

The most recent configuration in your account is the only one we will honor. Previous Nominees, once changed, have no claim to access your data.
